1. INTRODUCTION: DEFINITIONS, PURPOSE AND SCOPE OF APPLICATION.
These Terms of Use regulate the access, browsing and use of the web sites under the domain "cima.es" (hereinafter Website), as well as the responsibilities arising from the use of its contents (hereinafter "contents" are understood to be texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions, information and any other creation protected by national laws and international treaties on intellectual and industrial property).
User shall be understood as the person who accesses, navigates, uses or participates in the services and activities, free or onerous, developed on the Website, whether or not registered therein.
In addition to these Terms of Use, the Foundation for Applied Medical Research may establish special conditions governing the use and / or contracting of specific services offered to users through the Website.

The User accepts to send an e-mail to cima@unav.es for any communication related to the present Terms of Use or the access and use of the Website.
3. GENERAL CONDITIONS.
The headings of the various clauses are for information purposes only, and shall not affect, qualify or expand the interpretation of these Terms of Use. Also, the Foundation for Applied Medical Research may modify the terms and conditions stipulated herein, in whole or in part, publishing any changes in the same form in which this document appears or through any type of communication to users.
The User accepts that the access or the mere use of the Website implies knowledge and acceptance of the Conditions of Use, and if any, the particular conditions, which are published at the time of access or use in the Website itself, as well as any legal provision in force.
Regardless of the provisions of the particular conditions that may be established, the Foundation for Applied Medical Research may terminate, suspend or discontinue, at any time and without notice, access to the contents of the Website, without the possibility for the user to claim any compensation. After such termination, the prohibitions of use of the contents set forth above shall remain in force.
In the event of any discrepancy between the provisions herein and the particular conditions of each specific service of the Website, the provisions of the latter shall prevail.
The Foundation for Applied Medical Research may terminate or interrupt, at any time and without notice, access to all or part of the contents of the Website, without the User can claim any compensation. After such termination or interruption, the prohibitions of use of the contents set forth in these Terms of Use and in the particular conditions, if applicable, will remain in force.

4. SERVICES PROVIDED BY THIRD PARTIES.
Through the Website, the Foundation for Applied Medical Research may enable third parties to advertise or provide their services. In these cases, the Foundation for Applied Medical Research will not be responsible for establishing the general and specific conditions to be taken into account in the use, provision or contracting of these services, and therefore can not be held responsible for them. Before using and/or contracting such specific services, the User must carefully read the corresponding conditions created for this purpose by the third party entity. The use and/or contracting of such services implies acceptance of the conditions that regulate them.
The Foundation for Applied Medical Research does not guarantee the legality, legality, content, scope and reliability of the services provided by third parties through its Website. The Foundation for Applied Medical Research will not be liable for any damages that may be irrogárseles to users or third parties by the recruitment or enjoyment of the services provided by third parties through this page.

- The non-fulfillment, delay in the fulfillment, defective fulfillment or termination for any reason of the obligations contracted by third parties and contracts made with third parties.
5. ACCESS TO THE WEBSITE.
5.1. Conditions of access.
The access to the Website by the Users is free and free of charge. However, some of the services and content offered by the Foundation for Applied Medical Research or third parties through the Website may be subject to the prior contracting of the service or product and the payment of an amount of money in the manner determined in the relevant Special Conditions, in which case they will be made available to the User clearly.
When it is necessary for the User to register or provide personal data in order to access any of the services, the provisions of the Privacy Policy contained in the Website shall apply to the collection and processing of the User's personal data.
The contracting of products and services through the Website by minors is prohibited, and they must duly obtain prior consent from their parents, guardians or legal representatives, who will be considered responsible for the acts carried out by the minors in their care, in accordance with current legislation.

The User will use the contents of the Website in accordance with the Law and public order, refraining from using them for purposes or effects contrary to the Law, morality and good customs.

The Foundation for Applied Medical Research offers Users a contact channel through which you can communicate and bring to the attention of that the existence of any content with respect to which the User considers that are contrary to law or violate the legitimate rights of third parties.

The contents included in the Website are provided only to consumers or end users. Any unauthorized commercial use of the same or resale are prohibited, unless you have the prior written permission of the Foundation for Applied Medical Research.
If for the use and/or contracting of a service on the Website, the User should proceed to a registration or login procedure, the User will be responsible for providing true, lawful information and of which it is the sole owner. If, as a consequence of the registration, the User is provided with a password, he/she undertakes to use it diligently and to keep the password secret in order to access these services. Consequently, the User is responsible for the proper custody and confidentiality of any password that is provided by the Foundation for Applied Medical Research, and agrees not to transfer its use to third parties, whether temporary or permanent, or to allow access to outsiders. It will be the responsibility of the User the use of the services by any third party using for this purpose a password that had been provided to the User. Under the above, it is the obligation of the User to immediately notify the Foundation for Applied Medical Research of any misuse of passwords, as well as its theft and loss.
Access, navigation and use of the Website is the responsibility of the User, so the User agrees to diligently and faithfully observe any additional instructions given by the Foundation for Applied Medical Research or its staff regarding the use of the Website and its contents. We also urge you to inform the institution of any fact that becomes known and involves conduct contrary to law or violate the rights of any third party, preferably by e-mail to the address cima@unav.es.
It is not permitted and, therefore, its consequences will be the sole responsibility of the User, access or use of the Website for illegal or unauthorized purposes, with or without profit. In particular, and without the following list being restrictive in nature, it is forbidden to
- Use the Website in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in the computer equipment of a third party;
- Use the Website for the transmission, installation or publication of any virus, malicious code or other harmful programs or files, as well as to publish or disseminate content that is protected by the legitimate rights of third parties;
- Use the Website illegally, against good faith, morality or public order;
- Register through the Website with a false identity, impersonating third parties or using a profile or performing any other action that may mislead other Users or the Owner of the Website about the identity of the User;
- Unauthorized access to any section of the Website, other systems or networks connected to the Website, the servers of the Foundation for Applied Medical Research, or the services offered through the Website, through hacking techniques, identity theft or illegitimate use of credentials, password extraction or any other illegitimate means;
- Breaking, or attempting to break, the security or authentication measures of the Website or any network, system or device connected to it, or the security or protection measures inherent to the contents offered on the Website;
- Alter or attempt to alter the contents of the Website if you are not authorized to do so.
- Carry out any action that causes a disproportionate or unnecessary saturation in the infrastructure of the Website or in the systems or networks of the Foundation for Applied Medical Research, as well as in the systems and networks connected to the Website; or

Failure to comply with any of the above obligations by the user may lead to the adoption by the Foundation for Applied Medical Research of appropriate measures covered by law and in the exercise of their rights or obligations, including if necessary the removal or blocking of the account of the offending user, without the possibility of any compensation for damages caused. The Foundation for Applied Medical Research also reserves the right to initiate legal action it deems appropriate.
7. PARTICIPATION TOOLS.
The Foundation for Applied Medical Research is not responsible for the information and content stored in participation tools such as forums, chats, blogs, comments, social networks or any other means that allows users or third parties to publish content on the Website. However, and in compliance with the provisions of art. 11 and 16 of Law 34/2002 of 11 July, services of the information society and electronic commerce (LSSI), the Foundation for Applied Medical Research is available to all Users, authorities and security forces, actively collaborating in the removal or blocking of all content that could affect or contravene national or international law, rights of third parties or morality and public order.
In the event that a user considers that there is on the Website any content that could be susceptible to this classification, please notify the Foundation for Applied Medical Research, preferably by email to the address cima@unav.es.
The Foundation for Applied Medical Research expressly reserves the right to discontinue at any time and without notice, temporarily or permanently, the services referred to in this section.
8. CONTENT PROVIDED BY THE USER.
In the event that the User sends or publishes content of any kind on the Website, the User declares that he does so freely, that such content does not infringe intellectual or industrial property rights, trademark, patent, trade secret, or any other right that may be held by a third party, nor contravene in any way national or international law, morality, or public order.
The Foundation for Applied Medical Research may at any time and without liability or compensation to the User, suspend, block, limit access or remove content posted by the User if it becomes aware that it has incurred in a violation of the above, or if it considers that such content encourages any kind of discrimination or contravene morality or generally accepted social norms.
The publication or submission for publication of content on the Website implies the granting in favor of The Foundation for Applied Medical Research of an indefinite, free, irrevocable and non-exclusive license to reproduce, publish, adapt, modify and distribute such content. This license is granted in order to allow the adaptation of content to the requirements and technical characteristics of the Website and its graphical interfaces and the display of such content on the Website, as well as in other activities that could undertake The Foundation for Applied Medical Research.
The User acknowledges assuming responsibility and shall hold harmless the Foundation for Applied Medical Research for any damages arising from any content you personally provide or that a third party provides using the credentials of the User.
In the event that the content submitted by the User contains images, videos, voice, or other personal data of third parties, the User further represents, warrants and agrees that:
- That he/she is of legal age for legal purposes.
- That he/she is the author or copyright holder of said production and that he/she has the right to send it and that it does not infringe any intellectual or industrial property right.
- That he/she has informed the persons appearing therein that the aforementioned images, videos, voice recordings or other personal data have been made and will be published on the Website, that he/she has obtained their consent and, in the case of minors, that the aforementioned consent has been given in writing by their legal representatives, parents or guardians and may prove it at any time he/she is required to do so.
- That he/she has informed the persons appearing in the same or their legal representatives, in case of minors, of their rights regarding the protection of personal data.
The User acknowledges the assumption of responsibility for the above and will indemnify the Foundation for Applied Medical Research for all damages that his conduct, wilful or negligent, may cause him for his breach.
In all cases, the Foundation for Applied Medical Research, at its option and without justification, reserves the right to publish or not the content provided by the User.
9. RESPONSIBILITIES AND GUARANTEES.
The Foundation for Applied Medical Research states that takes reasonable measures, according to available technology and its capabilities, to ensure the proper functioning of the Website and prevent the existence and transmission to users and third parties of viruses or other harmful components. However, it cannot fully guarantee the invulnerability of the Website and therefore is not responsible for the following:
- The permanent availability of the Website or its lack of performance.
- The continuity of the contents of the Website.
- The damages that may occur to Users or third parties, including their devices and the information they may contain, due to viruses or other harmful components that may affect or transmit the Website or the servers that host it.
- Any damages caused to Users or third parties in case of violation of the Website's security systems.
- The damages that may be caused by any person who violates the Terms of Use or the particular conditions that the Foundation for Applied Medical Research has provided for access and use of the Website.
Nor can the absence of errors in the contents be fully guaranteed.
If the User becomes aware of the existence of any content that is illicit, illegal, contrary to the law or that may involve an infringement of third party rights, he/she must notify the owner entity as soon as possible so that it can proceed to the adoption of appropriate measures.
The Foundation for Applied Medical Research is not responsible for the accuracy, completeness or updating of the information published on the Website from outside sources, as well as those contained in other platforms that are linked from the Website. Neither shall it assume any responsibility for hypothetical damages that may arise from the use of such information.

10.1. Links to other websites and social networks (links).
The Foundation for Applied Medical Research may include on the Website buttons, links, banners, etc., that redirect to other websites, called links. All these elements are managed by third parties and the Foundation for Applied Medical Research assumes no responsibility for such links, being the third party responsible for their content and the goods or services that may be offered through such pages.
The Foundation for Applied Medical Research does not have human or technical means to know in advance, control or approve all information, content, products or services provided by other platforms to which links can be established from the Website. Consequently, the Foundation for Applied Medical Research can not assume any responsibility for any aspect of the platform or website to which a link may be established from the Website, specifically, but not limited to, on its operation, access, data, information, files, quality and reliability of its products and services, their own links and / or any of its contents in general.
In this sense, if users have actual knowledge that the activities carried out through these third party websites are illegal or contravene morality and / or public order, they must immediately notify the Owner for the purpose of proceeding to disable the link to access them, an action that will be carried out as soon as possible.

If any entity or User wishes to establish any type of link to the Website, the following rules must be followed.

The Foundation for Applied Medical Research may require the immediate withdrawal, without justification, to any third party that establishes on its website a link to a page of the Website and in the opinion of that does not conform to the above paragraphs.
It is not allowed to create a browser or a border environment on the sections of the Website, nor in any other way may the Website be modified.
It is not allowed to make false or inaccurate or incorrect statements or indications about the Website and / or, in particular, to state or imply that the Foundation for Applied Medical Research has authorized the link or has supervised or assumed in any way the content or services offered or made available to users by third parties.
11. APPLICABLE LAW AND JURISDICTION
The relationship established between the Foundation for Applied Medical Research and the User shall be governed by the provisions of the foral civil legislation of Navarra (Fuero Nuevo) and subsidiarily by other foral or common legislation that may be applicable, unless specific legislation on consumers and users expressly prohibits it.
Regarding jurisdiction, the Fundación para la Investigación Médica Aplicada and the User shall respect the provisions of the rules governing jurisdiction. In cases where such rules provide for the possibility for the parties to submit and choose a jurisdiction, the Foundation for Applied Medical Research and the User, expressly waiving any other jurisdiction that may apply, submit to the Courts and Tribunals of the city of Pamplona.
